December 2010

PROBLEM: Our client had a personal injury case involving a car accident in the snow. Our clients version of events differed from the other driver. The police report blamed our client for the accident. With liability in dispute, the insurer only offered $10,000.00 to settle.

RESULT: After an arbitration hearing, this office successfully secured a settlement of over $20,000.00.

PROBLEM: Our client had a personal injury car accident case with a $11,000.00 worker’s comp lien.  The insurance company initially offered only $20,000.00 to settle.

RESULT: This office negotiated with workman’s comp to reduce their attorney lien to $6,000.00.  Our office sent a 93A
demand against the insurance company because of their low offer.  As a result, the case settled for $35,000.00.

PROBLEM: Our client had a personal injury case with over $16,000.00 in unresolved liens.  The negligent party was only carrying a $20,000.00 policy.

RESULT: This office negotiated the liens down, the client was able to walk away with thousands of dollars in his pocket.

November 2010

PROBLEM: As a result of a hit and run accident, our client suffered serious injuries.  This office filed suit on her behalf.  The Defendant, represented by his insurance company, refused to comply with the rules of discovery.

RESULT: After a hearing on assessment of damages the Superior Court judge awarded over $30,000.00.

October 2010

PROBLEM:  Ourclient had a personal injury case with clear liability and six months of medical treatment with only a $9,500.00 offer.

RESULT:  After this office sent a 93A consumer protection demand to the insurance company,  the case eventually settled for   $21,000.00.

PROBLEM: Client had her case with another lawyer for one year. There was a small offer on the case. The client was unhappy because she wanted to settle and her old lawyer never updated her.

RESULT: Two weeks later our law office almost doubled the offer of settlement with the insurance company and settled               the client’s case.

PROBLEM: A 54 year old woman had not worked since January 2007. She desparately needed help getting Social Security Disability benefits.

RESULT: After her hiring our office in January 2008, our law office filed various appeals with Social Security and eventually having her case heard before an administrative law judge, she was awarded disability benefits in January 2009. My office also sucessfully argued that she was disabled since January 2007 and she was awarded retroactive disability benefits amounting to over $5,000.

PROBLEM: Our client was in an auto accident in July 2006. He only missed 4 days from work and then treated with a chiropractor for 6 more weeks. He wanted a good settlement.

RESULT: The client hired us in October 2008. My office was able to get him a $9,000.00 settlement just three months later.

PROBLEM: Our client, a 58 y.o. male, was a patron at a restaurant. He was injured in July 2008 when the restaurant’s chair in which he was sitting broke and he fell to the ground. The client wanted a settlement for his injuries and humiliation suffered.

RESULT: Even though the client suffered only soft tissue injuries and treated for just eleven weeks, my office was able to negotiate a settlement in December 2008 for our client in the amount of $13,500.00.

PROBLEM: A 53 year old man had not worked since January 1997 due to serious injuries. He had a different law fiorm handling his case. he recently lost before a judge at Hearing. He needed help with his Social Security Disability appeal.

RESULT: Our office helped the client re-apply for Social Security Disability benefits in September 2008. Just two months later our client was approved for Disability benefits.

PROBLEM: In June 2008, a 65 year old female was involved in an auto accident. Her injuries were not serious, but her medical bills exceeded the 8K PIP limit. She needed help in getting a settlement.

RESULT: My office was able to negotiate her medical bills so that nothing would be paid from her settlement. In January 2009 my office got the client an $11,000.00 settlement.

PROBLEM: A 58 y.o. Brazilian woman who could not speak very good English had not worked since May 2007 due to various injuries. She needed help in getting Social Security Disability benefits.

RESULT: The woman hired us in March 2008. My office helped her with her Social Security Appeal process. In August 2008, just 5 months later, were were able to assist our client with getting on Social Security Disability. She also received over $4,000.00 in retroactive benefits back to her disability date.

PROBLEM: A 28 year old woman was a passenger in an auto accident. The car she was in did not have insurance. She needed help getting her bills paid and getting a settlement.

RESULT: Our office was able to get her medical bills resolved as well as get her a $5,400.00 settlement all in less than six months.

Family Law

Problem: Client’s wife filed a motion to terminate all visitation with his child.

RESULT: The parties met with probation and still wife refused to allow visitation. After a hearing counsel was able to restore client’s parental rights with his child.

PROBLEM: In October 2010 our client’s ex-wife filed a motion for contempt and attorney’s fees for the non-payment of the children’s health insurance.

RESULT: After a hearing, our client was not found in contempt and no attorney’s fees were awarded.

Criminal Law

CHARGES: OUI, Negligent Operation

RESULT: After the Commonwealth failed to produce witnesses on the first scheduled date of trial. This office was successful in requesting the charges be dismissed.

CHARGES: Possession of a Large Capacity Firearm, Possession of a Firearm without an FID card, Discharge of a Firearm within 500ft of a Building.

FACTS: Client was facing mandatory jail time for possessing a firearm without a license. He was also facing an indictment to Superior Court on the large capacity charge.  Client came forward and admitted guilt in the matter. This office was able to negotiate with the District Attorney’s office and have the Possession of a Large Capacity Firearm and Possession of a Firearm without an FID card counts dismissed.

RESULT: Plea of Guilty on the Discharge of a Firearm count, 1 year administrative probation.

CHARGES: Drunk Driving

RESULT: Able to have client’s DWI charges dismissed and client was found responsible for reckless driving.

CHARGES: Operating Under the Influence 2nd offense

RESULT: NOT GUILTY after a jury trial

CHARGES: 2 Counts of Assault & Battery (2 counts), 2 Counts of Assault & Battery with a Dangerous Weapon

RESULT: At arraignment this office filed a motion to dismiss, which was allowed that day and the defendants charges were dismissed.

CHARGES: Possession of a class D with Intent to Distribute in a School Zone.

RESULT: Client was arrested dealing marijuana in a park, and faced a mandatory 2 year jail sentence. He was willing to accept the DA’s offer of two years probation which would also include a 2 year loss of license, however advised him to fight it and after a jury trial he was found NOT GUILTY of all charges.

CHARGES: possession of firearm w/o FID Card, Poss Firearm w/o a license, possession of ammunition, possession of firearm loaded, possession of class B w/ intent to distribute

RESULT: After a 3 day Jury Trial and only 5 minutes of deliberations the jury came back with a NOT GUILTY verdict on all counts.

CHARGES: Possession of cocaine with intent to distribute in a school zone

RESULT: Client was arrested with 75 baggies of cocaine in a park and faced a mandatory 2 year jail sentence and a 2 year loss of license, over the objection of the DA we asked the judge to continue the case without a finding for one year. The judge agreed, and the client did not go to jail or lose his license

CHARGES: 3 Counts of Assault & Battery, 2 Counts of Assault & Battery with a Dangerous Weapon, 2 Counts of Threats to Kill

FACTS: Client accused of striking his wife, trying to run her over with his car, threatening to kill her, and trying to smother her.  Client was also accused of threatening to kill another family member and assaulting another family member on 2 different occasions on the same day.

RESULT: After a two day trial and 7 witnesses called by the prosecution against the client, the client was found NOT GUILTY of all 7 counts charged against him.

CHARGES: Insurance Fraud and Conspiracy to Commit Insurance Fraud

RESULT: Client was charged with faking a car accident and filing a false insurance claim.  Prior to trial all charges were dismissed upon payment of a small fine.

Social Security Law

PROBLEM: Client hired us in June 2009. He had not worked in over a year and had many financial problems.

RESULT: We got him Social Security Disability benefits with retroactive from 03/08 by November 2009, just five months later!

PROBLEM: Hired us in May 2009. Client had not worked since 12/08.

RESULT: We got her SSDI benefits just five months later.

PROBLEM: Hired us in March 09. Client had not worked since August 08.

RESULT: We got him SSI benefits retroactive to January 09 in November 09.

PROBLEM: Client hired us September 29, 2009. He had not worked since September 2008.

RESULT: We got him SSDI benefits just two months later with retroactive from March 2009.

PROBLEM: Client hired us in December 2007. After losing at Hearing in April 2008, we didn’t give up. We filed a new Social Security Disability claim for him.

RESULT: He was awarded disability benefits in November 2009. The client received retroactive benefits from July 2008.

PROBLEM: The client hired us in September 2009. She was working part time at Papa Gino’s 20 hours per week just to try and make ends meet. We helped her initiate a claim for SSI benefits. We helped her obtain the essential medical reports to convince the local Social Security Office to put her on SSI in October 2009, so as to avoid a lengthy battle and go before a Judge in Boston.

RESULT: Benefits obtained.

PROBLEM: Client hired us in September 2009. We helped her file a claim for disability benefits at the local office. Her initial interview on October 16, 2009.

RESULT: She was awarded disability benefits just two weeks later on October 20, 2009.

PROBLEM: The client hired us in April 2009. We helped him obtain medical reports from his doctors which disabled him from working for free. We filed one appeal in April 2009.

RESULT: After supplying the local Social Security Office with the necessary medical evidence, the client was awarded SSDI benefits in November 2009, retroactive to February 2008.

PROBLEM: The client hired to help her get on SSI in September 2008. Our office filed her Social Security appeals and assisted her with obtaining her medical records. Our law office fought hard for the client and took her case to Boston before an Administrative Law Judge in July 2009

RESULT: We obtained a fully favorable decision with retroactive benefits totaling over $9,000.00 dating back to June 25, 2008.

PROBLEM: The client hired us in September 2008 to help get her SSI benefits. We filed her first appeal in September 2008. We requested a hearing before an Administrative Law Judge In May 2009. We took her case before an Administrative law Judge in July 2009.

RESULT: We won her case and she received a retroactive check in the amount of over $7,000.00.
